In a recent development, the Bureau of Land Management (BLM) has announced a key decision regarding a Categorical Exclusion for a proposed Right-of-Way (ROW) grant. This grant, under the Federal Land Policy and Management Act of 1976, pertains to a new Communication Use Lease at the existing Cherry Creek Communication Site, located on public lands near Cherry Creek in White Pine County, Nevada.
The proposed project is contingent upon the authorization of a FLPMA ROW grant, which is subject to a separate appealable decision in accordance with the Code of Federal Regulations, Part 43, Section 2800.
