North Carolina Seeks Federal Waiver to Exceed Alternate Assessment Cap

The North Carolina Department of Public Instruction (NCDPI) is taking steps to address educational assessment challenges by seeking a waiver from the federal government. The state is requesting permission to surpass the current cap on the number of students who can be evaluated using alternate assessments, which are typically employed for students with significant cognitive disabilities.

According to federal regulations, specifically section 34 C.F.R §200.6(c)(2), State Education Agencies are required to keep alternate assessments below a 1.0 percent threshold of the total student population assessed in any subject area. North Carolina anticipates it will exceed this limit and has requested a waiver from the Secretary pursuant to 34 C.F.R §200.6(c)(4) for the upcoming school year.

Public Input Invited on Waiver Request

The NCDPI is inviting feedback from the public regarding this waiver request. Individuals and organizations interested in contributing their perspectives can submit written comments. The comment period is open until January 21, 2026, providing ample time for stakeholders to express their views.
