Maricopa County Supervisor Seeks Independent Legal Counsel for Dispute


In a move to address ongoing disagreements over election duties, Maricopa County Supervisor Mark Stewart has decided to hire independent legal counsel. The focus of this legal guidance is the Shared Services Agreement with County Recorder Justin Heap, which has been a point of contention.

Over the past year, Supervisor Stewart has found himself at odds with fellow Board members on the agreement’s execution. Despite alignment on most county matters, the handling of the Recorder’s duties has been a sticking point since January 2025.

Stewart requested a postponement of a meeting planned for Wednesday, February 18, stating, “I vehemently reject any notion that this meeting could or should be used to remove the Recorder.” He emphasized his opposition to any discussions of removing Recorder Heap from office.

The root of the disagreement stems from a 2024 decision that reduced the Recorder’s election-related responsibilities significantly, a move Stewart has consistently opposed. He argues that Recorder Heap should at least have the same responsibilities as his predecessor, with any changes negotiated from there. Stewart has repeatedly made this recommendation both in meetings and in formal communications to the Board’s previous Chair, but it has been rejected.

The debate is a narrow one but holds significant implications, centering around statutory interpretation and the role of the County Recorder as expected by voters. Stewart remains committed to collaborating with his colleagues on other county issues, yet he believes this particular matter requires independent legal insight.

Engaging independent counsel aims to provide Stewart with objective legal advice in accordance with Arizona law, including A.R.S. §§ 11-251 and 16-401 et seq.

Stewart insists that Maricopa County residents deserve transparent and lawful election processes. His goal is to restore trust, ensure statutory adherence, and uphold open public meetings, all while respecting the authority of elected officials and maintaining effective election management.

He remains dedicated to working collaboratively with the Board, the Recorder, and county staff to find a resolution that benefits voters and boosts confidence in Maricopa County’s election integrity.
