The Bureau of Land Management (BLM) is taking steps to redefine land rights in its latest decision affecting the City of Fernley, Nevada. As part of this, administrative changes to nine existing rights-of-way (ROW) will be implemented, aligning with the Carl Levin and Howard P. “Buck” McKeon National Defense Authorization Act for Fiscal Year 2015, commonly referred to as the “Fernley Lands Bill.”
Under the new authorization from the BLM’s Sierra Front Field Office, seven rights-of-way governed by the Federal Land Management Policy Act (FLPMA) will now have perpetual terms. Meanwhile, two rights-of-way under the Mineral Leasing Act (MLA) are set to transition to new 30-year terms. This decision follows the BLM’s “Final Policy and Procedures for Issuance of ‘Long Term’ Right-of-Way Grants and Easements Over Public Lands to be Transferred Out of Federal Ownership.” Importantly, the modifications do not permit any ground disturbance or grant additional rights beyond the scope of the existing agreements.
