Maricopa County Board of Supervisors Seeks Stay in Legal Dispute with Recorder Heap

The Maricopa County Board of Supervisors is taking steps to delay the enforcement of a recent court decision impacting election procedures. In a move to maintain stability during the upcoming elections, the Board voted to request a stay, which would temporarily halt proceedings. Should this request be denied, the Board plans to pursue an appeal.

With early voting for the May 19th jurisdictional elections already underway and the primary election rescheduled for July, the Board emphasizes the need to avoid hasty changes. Ambiguities in state laws regarding the responsibilities of the Recorder’s office and the Board have led to confusion. There is concern among election staff about potential contempt of court charges as they perform essential election duties. The complex IT systems shared between the Board and the Recorder’s office also require careful handling to prevent disruptions.

By seeking a stay, the Board aims to gain time to resolve these ambiguities and implement any changes in a deliberate manner. The Board has expressed a commitment to clarifying roles and responsibilities in election administration to ensure seamless operations.

If the request for a stay is denied by the lower court, the Board is prepared to escalate the matter through an appeal. Efforts to resolve the conflict with Recorder Heap outside of court have been unsuccessful, leading to the ongoing legal proceedings initiated by Recorder Heap last June.

The overarching goal of the Board remains to conduct secure and efficient elections that uphold voter confidence. The Board has reiterated its dedication to achieving this objective amidst the current legal challenges.
