Former NC Governors Support Stein in Power Dispute at Supreme Court

The ongoing legal debates surrounding gubernatorial powers in North Carolina are drawing significant attention, as former state leaders and legal experts unite in support of the current Governor. Their involvement highlights the critical nature of these cases, which could redefine the balance of power within the state government.

Support from Former Governors

All five living former governors of North Carolina have joined forces in a rare display of unity to support Governor Stein in the landmark cases of Stein v. Berger and Stein v. Hall. Jim Martin, Mike Easley, Bev Perdue, Pat McCrory, and Roy Cooper submitted a friend-of-the-court brief to the North Carolina Supreme Court. They assert that their collective experience provides a profound insight into the practical workings of the separation of powers, emphasizing their nonpartisan stance on this constitutional issue.

Academic Insight on Constitutional Authority

Renowned constitutional scholar and law professor, John Orth, along with UNC adjunct law professor Charles Plambeck, has also offered a legal perspective on the matter. Their friend-of-the-court brief argues against a 2024 law that limits the Governor’s authority to appoint judges to the North Carolina Court of Appeals and Supreme Court. They maintain that such restrictions imposed by the General Assembly are unconstitutional and infringe upon the Governor’s designated powers.

Upcoming Court Proceedings

The North Carolina Supreme Court is set to hear oral arguments for both Stein v. Berger and Stein v. Hall on November 10. This anticipated hearing will be crucial in determining the future scope of gubernatorial authority in the state.
